$415,000 For Workplace Injury

Bashir v. Maintech Corp.: A Federal Express package handler, injured when his had was dragged by a conveyor belt into a sorting machine and crushed, reached a $415,000 settlement with the machine’s manufacturer and two other companies.

Maintech Corp. of South Plainfield will pay $385,000. Southern Systems Inc., the conveyor assembler, and Industry General Corp., the engineer for the conveyor, both of Memphis, Tenn., will pay $15,000 each. The settlement was reached on Sept. 27 before Hudson County Superior Court Judge Maurice Gallipoli.

On Sept. 13, 1994, the plaintiff, Shaid Bashir, 25, of Jersey City, was employed by FedEx as a document sorter, loading bags onto an unguarded conveyor belt. His left hand became snared in the machine, dragging in his arm and crushing his hand.

Bashir’s injuries required four operations, including a skin graft and internal fixation of the humerus. He was left with limited movement and a scar from his shoulder to his wrist, according to his attorney, Springfield solo practitioner Shelley Stangler. She says Maintech had an affirmative duty to inspect the machine, through its maintenance agreement with FedEx.

Maintech’s attorney, a partner Clark McFadden with Roseland’s Weston, Stierli and McFadden, confirms the settlement.
